The Illinois Supreme Court has overturned actor Jussie Smollett’s conviction, ruling that his second prosecution for filing a false police report violated his constitutional rights. The court determined that Smollett was unjustly prosecuted after an earlier agreement with state prosecutors had resolved the charges.

In January 2019, Smollett reported being the victim of a racist and homophobic attack in downtown Chicago. He claimed two men physically assaulted him while shouting slurs and declaring, “This is MAGA country.” The report initially drew national attention and widespread condemnation of hate crimes.

Authorities later accused Smollett of orchestrating the attack, alleging he recruited two brothers, Abimbola and Olabinjo Osundairo, to stage the incident. He was charged with felony disorderly conduct for filing a false police report. In a 2019 resolution, prosecutors dropped the charges after Smollett forfeited his $10,000 bond and completed community service. However, public backlash led to appointing a special prosecutor who revived the case.

Smollett was convicted on five counts of felony disorderly conduct in 2021, based largely on testimony from the Osundairo brothers, who said Smollett planned and directed the staged assault. He was sentenced to five months in jail in 2022 but served just six days before being released pending appeal.

On Thursday, Nov. 21, the Illinois Supreme Court ruled 4-2 in Smollett’s favor, citing violations of his due process rights. “We hold that a second prosecution under these circumstances is a due process violation, and we therefore reverse defendant’s conviction,” Justice Elizabeth M. Rochford wrote.

Nenye Uche, Smollett’s attorney, welcomed the ruling. “We are thankful to the Illinois Supreme Court for restoring order to Illinois’ criminal law jurisprudence,” Uche stated. “This decision is a victory for justice and due process.”

Smollett’s acting career began in childhood, with early roles in films such as The Mighty Ducks (1992) and North (1994). In the mid-1990s, he co-starred with his siblings on the sitcom On Our Own. After a hiatus, Smollett returned to the spotlight as a musician, releasing the EP Poisoned Hearts Club in 2012, and as an actor in the independent film The Skinny.

In 2015, Smollett achieved widespread recognition for portraying Jamal Lyon on the hit TV series Empire. Jamal, the openly gay son of music mogul Lucious Lyon, became a groundbreaking character for LGBTQ+ representation on television. Smollett also contributed original music to the show’s soundtrack, which became a commercial success. His performance earned him critical acclaim and a recording contract with Columbia Records.

Smollett described his role on Empire as one of the highlights of his career, noting the impact it had on fans. “I received a letter from a kid that said Jamal gave him the courage to come out to his parents. It touched me deeply, and it’s an honor to help people,” he said in a 2015 interview.

While his legal troubles resulted in Jamal being written out of Empire during its final season, Smollett’s contributions to the show remained significant. His attorneys hope he can now rekindle his career.

“This case has always been about protecting constitutional rights,” Uche remarked. “Today, justice has prevailed.”

Nominations for the 75th Emmy Awards were announced today from the Hollywood Athletic Club, recognizing extraordinary programming, performances and a diverse range of exceptional storytelling across multiple platforms.

The live virtual ceremony was hosted by Emmy Award-nominated actress Yvette Nicole Brown and Television Academy Chair Frank Scherma.

This season, the Emmy Awards celebrates its 75th Anniversary and the nominations were streamed live from the place it all began in 1949, the famed Hollywood Athletic Club. That relatively modest Los Angeles-area ceremony which featured just five awards categories and $5 admission tickets has evolved into television’s biggest night, celebrating excellence throughout the industry and viewed by television fans around the world. In the age of “peak TV” with close to 600 original scripted series, the nominations recognize the importance of the performers, producers, writers, directors, craftspeople, and all those who worked on television programs in the past year.

There are more than 20,000 voting members of the Academy and this year’s nominations marked the highest voter participation in Emmy history.

Succession holds this year’s top spot with 27 Emmy nominations followed by The Last of Us (24), The White Lotus (23) and Ted Lasso (21).

“We are thrilled with the historic level of participation from our voting members this Emmy season,” said Scherma. “As we approach the remarkable milestone of the Emmy’s 75th anniversary, the Academy is more appreciative than ever of another year of extraordinary content. There were 38 first-time performer nominees across all performer categories this season including Jessica Chastain (George & Tammy), Elizabeth Debicki (The Crown), Taron Egerton (Black Bird), Riley Keough (Daisy Jones & The Six), James Marsden (Jury Duty), Jenna Ortega (Wednesday), Pedro Pascal (The Last of UsSaturday Night Live, and Patagonia: Life on the Edge of the World), Aubrey Plaza (The White Lotus), Daniel Radcliffe (Weird: The Al Yankovic Story), Bella Ramsey (The Last of Us), Alan Ruck (Succession), Jason Segel (Shrinking), Jeremy Allen White (The Bear) and Steven Yeun (BEEF).

In addition to Pascal, performers with multiple nominations this year include Murray Bartlett (The Last Of Us and Welcome To Chippendales), Alex Borstein (The Marvelous Mrs. Maisel and Family Guy), Quinta Brunson (Abbott Elementary and Saturday Night Live), Bill Hader (performance, directing and writing for Barry), Sharon Horgan (performance and writing for Bad Sisters), Melanie Lynskey (Yellowjackets and The Last of Us), Jason Sudeikis (performance and writing for Ted Lasso), and Ali Wong (BEEF and Tuca & Bertie).

The nominations rosters may be revised in cases where names or titles are incorrect or appeals for changes—including the addition or removal of names—are approved by the Television Academy’s Emmy Awards Committee. Producer eligibility is based primarily on title; producer nominees in certain program categories will be announced mid-August and may increase the number of multiple nominees. Final-round online voting begins August 17, 2023.

The 75th Emmy Awards is currently scheduled to broadcast live on FOX on Monday, September 18, (8:00-11:00 PM EDT/5:00-8:00 PM PDT) from the Peacock Theater at L.A. LIVE. The 2023 Creative Arts Emmy Awards are currently scheduled to take place at the Peacock Theater over two consecutive nights on Saturday, September 9, and Sunday, September 10. An edited presentation is currently planned to air on Saturday, September 16, at 8:00 PM EDT/PDT on FXX.

The BBC has today announced Ncuti Gatwa is the new Doctor set to take charge of the TARDIS. Star of stage and screen, Ncuti is best known for his critically acclaimed performance in Sex Education as the iconic Eric Effiong, for which he was awarded Best Actor Award at the Scottish BAFTAs in 2020 as well as numerous nominations including Best Male Performance in a comedy programme at this year’s BAFTAs.

LOS ANGELES, Calif. — Television icon Ed Asner has died at the age of 91.

Asner’s family confirmed his passing in a tweet, saying the actor died peacefully Sunday morning.

“We are sorry to say that our beloved patriarch passed away this morning peacefully. Words cannot express the sadness we feel. With a kiss on your head, Goodnight, dad. We love you,” wrote his family.

Many know Asner for his role as Lou Grant from “The Mary Tyler Moore Show” and his spin-off series “Lou Grant,” which aired in the 1970s and 1980s.

Asner is the most awarded male performer in the history of the Primetime Emmy Awards, with seven awards, Deadline reports.

He also starred in many films, like “Up,” “El Dorado,” and “Elf,” to name a few.

Along with his acting work, Asner also served as the president of the Screen Actors Guild and worked as an activist for a variety of causes.
